Privacy Notice

In accordance with the Federal Law on Protection of Personal Data Held by Private Parties (the “Law”), its Regulations, and the Privacy Notice Guidelines, Ferrocarril Mexicano, S.A. de C.V. (hereinafter “Ferromex”), with registered address at Bosques de Ciruelos 190, Colonia Bosques de las Lomas, Miguel Hidalgo, Mexico City, C.P. 11700, is responsible for the processing and protection of the personal data of its clients and/or users of its products and services.

The Personal Data collected will be used for the following purposes:
  1. Primary purposes (necessary for service provision)
    • Provide the services requested by the client and/or user.
    • Inform about changes or new products or services related to those acquired.
    • Fulfill contractual obligations with clients and/or users.
    • Issue invoices for services rendered.
    • Manage collections and payment procedures.
    • Verify compliance with legal requirements within the country.
    • Facilitate sales and other transactions on the website.
    • Deliver requested goods and/or services.
    • Use financial data exclusively for processing refunds.
  2. Secondary purposes (optional for the user)
    • Communicate updates about Ferromex services.
    • Send advertising and promotions.
    • Analyze the effectiveness of advertising and promotional campaigns.
    • Enroll clients in refund and quality assurance programs.
Note: The user may object to the processing of their data for secondary purposes through the mechanisms described in this Privacy Notice.
Personal data of minors, elderly individuals, especially vulnerable persons, or individuals with disabilities will be processed exclusively for service provision. Specific protection measures are implemented, including:
Processed data includes:
  • Name, contact address, phone number, email, gender, age, date of birth, and nationality.
Ferromex does not collect data from minors under 13 years old residing in Mexico.
  1. Types of Personal Data Collecte
    • Identification data: Name, address, phone number, date of birth, gender, nationality, email, Federal Taxpayer Registry (RFC).
    • Financial and patrimonial data: Bank, account number, credit card, interbank CLABE, verifiable income, employment status.
    • Video surveillance data: Images captured in waiting rooms and onboard passenger trains (deleted within 72 hours unless an incident occurs or is required by authorities).
  2. Confidentiality Protection
    • Ferromex safeguards data under principles of loyalty and responsibility, applying strict security measures.
    • Data will be retained only for the time necessary to fulfill processing purposes.
    • Once purposes are fulfilled, data will be canceled unless legal provisions require retention.
    • Ferromex does not store sensitive personal data such as racial or ethnic origin, religious beliefs, health status, union affiliation, political opinions, or sexual preferences.
Ferromex may disclose information in the following cases:
  1. By legal mandate or competent authority
    • To comply with legal processes.
    • To respond to claims related to third-party rights.
    • To protect the rights, property, or safety of Ferromex, clients, and the general public.
  2. Transfers without consent (as permitted by Law)
    • Controlled companies, subsidiaries, or affiliates of the same corporate group.
    • Entities with a legal relationship.
    • Financial institutions and insurers for service management.
    • Competent authorities in compliance with regulations.
Users may exercise their rights of Access, Rectification, Cancellation, and Opposition (ARCO), as well as revoke consent, by sending a request to tequila.express@ferromex.mx, including:
  • Full name
  • Official identification
  • Physical or electronic address
Deadlines and procedure:
  1. If the request is incorrect or incomplete, Ferromex will request additional information within 5 business days. The user must respond within 10 business days.
  2. Ferromex will issue a resolution within a maximum of 20 business days and, if applicable, execute it within 15 additional business days.
  3. If ARCO rights are restricted for national security or other legal provisions, the user will be notified.
  4. The exercise of these rights is free of charge, except for reproduction costs.
